If you have been arrested for felonious assault in the state of Michigan, you might face additional charges if the crime involved a firearm. According to section 750.82 of the Michigan penal code:
“A person who assaults another person with a gun, revolver, pistol, knife, iron bar, club, brass knuckles, or other dangerous weapon without intending to commit murder or to inflict great bodily harm less than murder is guilty of a felony punishable by imprisonment for not more than 4 years or a fine of not more than $2,000.00, or both.”
If you commit an assault with a firearm in a weapon free school zone, you can be charged with a felony that is punishable by the following:
- Up to four years in prison
- Up to 150 hours of community service
- A fine of up to $6,000
Under the law, a school is defined as “a public, private, denominational, or parochial school offering developmental kindergarten, kindergarten, or any grade from 1 through 12.”
The following things can be considered “school property”:
- Buildings
- Playgrounds
- Fields
- Property used for instructional purposes
- Property used for school sponsored functions and events
Any property and vehicles used by a school to transport students are also considered part of a “weapon free school zone.”
